Why it was refused
- The proposed development would involve the installation of a replacement extraction flue and associated plant to serve the extended restaurant use. However, insufficient information has been submitted regarding the location, specification and acoustic performance of the proposed extraction equipment, and a Noise Impact Assessment has not been provided. As a result, the Local Planning Authority cannot be satisfied that the development would not give rise to unacceptable noise and vibration impacts to nearby residential occupiers, particularly those within adjoining residential properties. The proposal is therefore contrary to Policy DMP1 of the Brent Local Plan (2019-2041), which seeks to ensure that development does not adversely affect the amenities of neighbouring occupiers.
- The application site is located within an area identified as being at risk of surface water flooding and within a Critical Drainage Area. In the absence of a Flood Risk Assessment and drainage strategy, insufficient information has been submitted to demonstrate that the development would be safe from flooding for its lifetime, would not increase flood risk elsewhere, and would make adequate provision for the management and reduction of surface water runoff. The proposal is therefore contrary to Policies BSUI3 and BSUI4 of the Brent Local Plan (2019-2041) and national planning policy relating to flood risk and sustainable drainage.
- The application has not been accompanied by a Fire Safety Statement or any other supporting information demonstrating how fire safety considerations have been incorporated into the design of the development. In the absence of such information, the Local Planning Authority cannot be satisfied that the proposal would provide appropriate fire safety measures, suitable means of escape and evacuation, adequate access and facilities for fire-fighting operations, or otherwise achieve the highest standards of fire safety. The proposal therefore fails to demonstrate compliance with Policy D12A of the London Plan (2021) and is accordingly unacceptable.
