Why it was refused

  1. The proposed dwelling would be located outside of the settlement boundary and would not be essential in the countryside. Whilst the Council cannot demonstrate a 5- year Housing Land Supply, the National Planning Policy Framework advocates presumption in favour of sustainable development, and the application site is not in a sustainable location due to it being in an isolated location without close and convenient access to public transport and local facilities. The provision of an additional dwelling would make a very modest contribution to the Council's Housing Land Supply, and considered in conjunction with the unsustainable location of the site, on balance, would not outweigh the harm in departing from the development plan. The proposal is contrary to Policy COM2 of the Test Valley Borough Revised Local Plan 2016 and Policy EL P7 of the Over Wallop Neighbourhood Plan 2024.
  2. Insufficient information has been submitted to demonstrate that the proposals can be carried out without harm to protected species. The proposals are therefore contrary to Policy E5 of the Test Valley Borough Revised Local Plan and the Conservation of Habitats and Species Regulations 2017 (as amended).
  3. The proposed development by means of its nature, location and scale could have likely significant effects upon the nearby Solent and Southampton Water European Designated Site which is designated for its conservation importance. In the absence of a nitrate calculations and a completed legal agreement for securing mitigation the applicant has failed to satisfy the Council that the proposal would not adversely affect the special interest of the Solent and Southampton Water European Designated Site, therefore the application is contrary to Policy E5 and E8 of the adopted Test Valley Borough Revised Local Plan (2016) and the Conservation of Habitats and Species Regulations 2017 (as amended).
