Refused

Why it was refused

  1. The Local Planning Authority considers that the works carried out represent inappropriate development within the Green Belt that, by reason of its prominent location, scale, design and materials, results in a harmful intrusion causing significant harm to the openness and character and appearance of the Green Belt. In the absence of very special circumstances it is considered that there are no reasons to justify making an exception to the general presumption against inappropriate development in the Green Belt. As such the application is contrary to Policy SP10 and P10 of the Leeds Core Strategy, and Policies GP5, N32, N33, N25, as well as specifically saved Policies GB19 and GB20, of the Unitary Development Plan (Review) 2006, and policy GB7:F(iv) of the NPPF.
  2. The Local Planning Authority determines that insufficient ecological information has been submitted to determine the condition of existing habitats on site, as well as the extent of habitat loss arising from development, and whether the proposal would therefore be able Merrion House 110 Merrion Centre Leeds LS2 8BB Town and Country Planning Act 1990 to achieve biodiversity outcomes required by development plan policy and national legislation. In the absence of the appropriate ecological information and a satisfactory biodiversity assessment, the Local Planning Authority is unable to conclude whether the proposal would appropriately conserve or enhance biodiversity, or achieve the proposed net gain. Therefore the proposal conflicts with Policies G9 and P12 of the Leeds Core Strategy, as well as LD1 of the Saved UDP Policies, and N2 of the NPPF.
  3. The Local Planning Authority considers that the proposal would adversely affect the use of definitive footpath Morley No.36, as the erection of the fencing within the proposed proximity is considered inappropriate, and would fail to enhance and protect the existing public right of way network. The proposal is not considered to be acceptable under standards set by the Public Rights of Way service in internal policy document: "Guidance for Developers: Public Rights of Way and Planning Applications", in accordance with NPPF TR8:1(a) and our statutory duty under S130 of the Highways Act 1980.
