Planning Decision

Decision
Refused

Why it was refused

  1. The Local Planning Authority considers that the proposed development, by reason of its prominence, scale, siting and design, would fail to respect the character, scale and appearance of the host dwelling and would erode the openness of this prominent corner plot within the Whinbrook Grove cul-de-sac. As a consequence, the development would result in a cramped, overly dominant and incongruous form of development that would fail to respond positively to its context, causing harm to the character and appearance of the application site and the wider street scene. The proposal is therefore contrary to National Development Management Policies DP3 and DP4 of the National Planning Policy Framework, Core Strategy Policies P10 and P12, Saved UDP Review Policies GP5 and BD6, and the Householder Design Guide SPD.
  2. The Local Planning Authority consider that the proposed two-storey side extension, by reason of its excessive projection beyond the rear elevation of No. 138 King Lane, its proximity to the shared boundary, and its scale and height, would result in an overbearing and dominant form of development that would create an unacceptable sense of enclosure Merrion House 110 Merrion Centre Leeds LS2 8BB Town and Country Planning Act 1990 for the occupiers of that property. Furthermore, due to its position to the south of No. 138 King Lane, the extension would cause significant overshadowing of the neighbouring rear garden and habitable room windows, to the detriment of the living conditions and residential amenity of neighbouring occupiers. The proposal is therefore contrary to Core Strategy Policy P10, Saved UDP Policy GP5, Policy HDG2 of the Householder Design Guide SPD and National Development Management Policy P3, which seek to safeguard residential amenity.
