Why it was refused
- By reason of their excessive bulk, mass and cumulative depth across the full width of the building, as well as the fenestration layout, the proposed rear extensions would significantly harm the character and appearance of the host dwelling and character of the area. Further, the proposed rear dormer, incorporating an inset balcony, would appear as an incongruous addition that fails to respond to the established roofscape and character of the area. The proposal would therefore conflict with Policy D3 of the London Plan (2021) and Policies SP4 and DM10 of the Croydon Local Plan (2018).
- The proposed development would fail to provide an acceptable standard of accommodation for future occupiers. It has not been demonstrated that the loft unit would achieve the required minimum floor to ceiling heights and habitable rooms within the ground floor would experience poor outlook by reason of their proximity to the adjoining boundary. The development would not offer an acceptable quality of private amenity space for future occupiers and no communal amenity space or children’s play space is proposed. The proposal would therefore conflict with Policy D6 of the London Plan (2021) and Policies SP2.8 and DM10 of the Croydon Local Plan (2018).
- By reason of the relationship between the proposed ground floor side facing window serving Flat 1 and the side facing window of the adjoining property, the proposed development would result in an unacceptable degree of overlooking and loss of privacy to the detriment of the residential amenity of the adjoining occupiers. The proposal is therefore contrary to Policy D3 of the London Plan (2021) and Policy DM10 of the Croydon Local Plan (2018).
- The proposed cycle storage fails to demonstrate compliance with the London Plan cycle parking standards and the London Cycling Design Standards in terms of capacity, layout, accessibility and provision for larger or adapted cycles. The proposal would therefore conflict with Policy T5 of the London Plan (2021) and Policies DM29 and DM30 of the Croydon Local Plan (2018).
- The proposed refuse and recycling arrangements, by reason of their location along the side path adjacent to the neighbouring property and the requirement to cross third party land, would fail to provide a suitable and practical solution. Furthermore, no provision has been made for an enclosure, food waste storage or bulky waste. The proposal would therefore conflict with Policy DM13 of the Croydon Local Plan (2018).
- In the absence of a completed legal agreement, the development has failed to secure the removal of future occupiers' eligibility for parking permits within the Controlled Parking Zone and access to Council operated car parks, as well as a financial contribution towards sustainable transport improvements. The proposal would therefore conflict with Policies SP8.12 and SP8.13 of the Croydon Local Plan (2018) and Policies T5 and T6 of the London Plan (2021).
