Why it was refused

  1. It is considered that the proposed development would be located outside of a settlement and would fail to find support under any of the developments listed under Policy S5(1) of the NPPF 2026. Consequently, a principle of development has not been established and there are no exceptional circumstances which might lead to the development being approved in spite of this fact, as per Policy S5(4) of the NPPF.
  2. The proposed development would not constitute a conversion of the existing agricultural building, as the building is not capable of conversion without significant rebuilding or modification. Further, the change of use and alterations to the building and site would result in harm to its agricultural character while failing to respect local residential character. The design is considered to fail to conserve and enhance the High Weald National Landscape through the use of inappropriate materials and the excessive number of rooflights which would result in harm to the National Landscape's dark night skies through light pollution. Accordingly, the proposal is contrary to Saved Policies GD2, EN1, EN6, DC6, DC7; Section 11 of the Wealden Design Guide 2008; Policy N4 of the NPPF 2026; and Section 85 of the Countryside and Rights of Way Act 2000.
  3. In addition, insufficient information has been provided to establish that the reduced visibility splays at the proposed holiday lets' access onto the highway would not present an unacceptable highway safety risk. Furthermore, the proposed parking arrangements are not satisfactory due to the need to access this area over land outside of the site's red line area. Accordingly, the proposal is contrary to Saved Policies TR3 and TR16 of the Wealden Local Plan 1998 and Policies TR4 and TR6 of the NPPF 2026. pdnRS.docx IMPORTANT: See Notes overleaf
