Planning Decision

Decision
Refusal

Why it was refused

  1. The proposed development would not accord with Natural England and the Forestry Commission's standing advice with regard to ancient woodland and buffer zones. Development within the buffer zone and introducing vehicular movement, fumes, and noise as well as human activity and underground utilities/plant would result in the loss of irreplaceable habitats and ecology associated with the Ancient Woodland. This development is not a wholly exceptional reason and therefore is contrary to Saved Policy EN13 of the adopted Wealden Local Plan 1998, WCS12 and WCS13 of the adopted Wealden District Council Core Strategy Local Plan 2013, and Policy HNDP 4 and 5 of the Hellingly Neighbourhood Plan, and therefore should be refused in line with paragraph N6(2) of the National Planning Policy Framework 2026.
  2. The introduction of the holiday let and removal of protected tree would intensify the pressure on the remaining protected trees and is not justified by the benefits of the development. This conflicts with Saved Policy EN12, EN13, EN14 of the adopted Wealden Local Plan 1998, WCS12 and WCS13 of the adopted Wealden District Council Core Strategy Local Plan 2013, and paragraph N2(1)(d) of the National Planning Policy Framework 2026.
