Why it was refused

  1. Insufficient information has been submitted to demonstrate that the building to be converted is in agricultural use as part of an established agricultural holding. The extent of any agricultural holding associated with the building is also unknown, so it is not possible to confirm whether there have been any previous disqualifying developments within the original limits of an established agricultural unit. In addition, details submitted with the application confirm that the internal floor space of the proposed dwellinghouse would exceed 150 square metres. The proposals fail to comply with the provisions set out at Q.1 (a)(i), Q.1(a)(ii), Q.1(c), Q.1(d) and Q.1(g) of Class Q, Part 3, Schedule 2 of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) and it has not been demonstrated that the proposals are permitted development.
  2. The proposed dwelling would be in close proximity to industrial and agricultural uses, including within the same building. Insufficient information has been submitted to demonstrate that they future occupiers of the proposed dwelling would not be adversely impacted by noise. Prior approval regarding noise impacts is required and cannot be granted. The application is therefore contrary to Q.2(1)(b) of Schedule 2, Part 3, Class Q of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), Policies E8 and LHW4 of the Test Valley Borough Revised Local Plan 2016 and Policies L2, P3 and P4 of the National Planning Policy Framework 2026.
  3. The submitted application has not demonstrated that the location and siting of the building would not make it impractical and undesirable for conversion to residential use with regard to noise and odour resulting from the close proximity to industrial and agricultural uses, including within the same building. Prior approval is required and cannot be granted. The application is therefore contrary to Q.2(1)(e) of Schedule 2, Part 3, Class Q of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), Policies E8 and LHW4 of the Test Valley Borough Revised Local Plan 2016, and Policies L2, P3 and P4 of the National Planning Policy Framework 2026.
  4. The footprint of the part of the building proposed to be converted measures 151.11 square metres, but the proposed curtilage measures 180 square metres. The application is therefore contrary to Q.3(1) of Schedule 2, Part 3, Class Q of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended).
