Why it was refused

  1. The Management and Maintenance Scheme does not include points to address the requirements to agree and transfer a commuted sum for the POS and the SuDS as follows. Schedule 4 Part 5 & 6 of the S106 dated 28 April 2015 sets out the requirements of the Maintenance Scheme. No information has been submitted to address much of Part 6 including clause 5.1. Definition of the 'Management Company' requires details that have not been submitted. Schedule 2 Parts 4 & 5 of the Section 106 Agreement dated 6 June 2016 sets out the requirements of the Maintenance Scheme. Insufficient information has been submitted to address Part 5 Clauses 5.2, 5.3, 5.4, 5.5, and 5.6. Clauses 5.2/5.3 requires the agreement and a payment to cover maintenance for a 7-year period. Definition of the 'Management Company' requires details that have not been submitted. Schedule 5 of the S106 dated 28 April 2015 sets out the requirements for the SuDS, including Part 3 clauses 4.2 and 7 the agreement and payment of a SuDS Commuted Sum to the management company and in clause 9.2 a Final Completion Certificate to be obtained for the SuDS prior to transfer to a management company.
