Planning Decision
Why it was refused
- The principle of this proposed development is unacceptable. Policies AS.10 and CS.22 of the Core Strategy support forestry and commercial development in the countryside in particular circumstances however none of these apply in the instance. This scheme is found to be discordant, results in an unsustainable form of development and fails to be compliant with the above policies of the Development Plan. This proposal is therefore considered to be unacceptable and fails to comply with the principles of Policies CS.15, CS.22 and AS.10 of the Core Strategy and NDMP S5 of the NPPF.
- The Local Planning Authority considers the unjustified expansion of the commercial enterprise into the open countryside would be likely to intensify the use of the site and result in an urbanising influence that would contrast markedly with the prevailing rural character of the area. The development would represent a significant detrimental effect on the natural, open rural landscape at this point. The proliferation of built form, hard standing, acoustic fencing, entrance gate and commercial development would lead to a harmful development in an area of high landscape quality. The application is therefore contrary to NDMP N2 to and policies Case Officer: Catherine Gibbons Reference No. 26/02114/FUL CS.5, CS.9, and AS.10 of the District's Core Strategy (2011-2031) and NDP Policy BE2.
- The application fails to provide sufficient information to demonstrate that a safe and suitable means of access to the site can be achieved for all users. In the absence of a Road Safety Audit, the Local Planning Authority cannot be satisfied that a safe, suitable and deliverable access can be achieved which would not cause significant and demonstrable harm. The proposal is therefore contrary to NDMP TR6.4 of the National Planning Policy Framework and Policy CS.26 of the Core Strategy.
- The introduction of built form in the manner proposed would result in the loss of the ridge and furrow within the site which is identified as being of national importance. The proposed development would therefore fail to preserve or enhance this non- designated heritage asset. Public benefits have been considered, however, are not considered to outweigh the harm identified. The development is therefore contrary to NDMP HE.7, Core Strategy policy CS.8 and Policy BE1 of the Tysoe Neighbourhood Development Plan.
