Planning Decision

Decision
Prior Approval Required - Refused
Case Officer
Mr Thomas Byford - planning.applications@rochford.gov.uk

Why it was refused

  1. The proposed additional storey, by reason of its substantial height, full-depth form and close relationship with the rear elevation and shallow south-facing garden of No. 61 Oak Walk, would introduce a visually dominant, overbearing and enclosing form of development. Given its position directly to the south of that property, the development would also result in a material loss of sunlight to its rear garden and rear-facing accommodation. Furthermore, the proposed first-floor rear windows would introduce an elevated vantage point resulting in materially increased overlooking and loss of privacy to the private rear garden of No. 59 Oak Walk. The proposal would therefore cause unacceptable harm to the amenity of adjoining premises and prior approval is refused under paragraph AA.2(3)(a)(i) of Schedule 2, Part 1, Class AA of the Town and Country Planning (General Permitted Development) (England) Order 2015, as amended. The applicant may appeal against this decision to the Planning Inspectorate under the householder appeal process.
