Planning Decision
Why it was refused
- The proposal constitutes inappropriate development within the Green Belt that would be harmful to the openness of the Green Belt and conflict with the purposes of including land within it. No very special circumstances outweigh the harm caused and the proposal is therefore contrary to policy CS6 of the North Somerset Core Strategy, policy DM12 of the North Somerset Sites and Policies Plan (Part 1) and section 13 the National Planning Policy Framework.
- The proposed development is on a site outside a settlement boundary and is in an unsustainable location which is contrary to policies that control residential development in the countryside, that are contained in the adopted development plan, which direct development away from unsustainable locations. As such the proposal is contrary to Policy CS1, CS14 and CS33 of the North Somerset Core Strategy and Policy SA2 of Sites and Policies Plan Part 2 (Site Allocations Plan).
- It has not been demonstrated that there will not be a likely significant adverse effect on the North Somerset and Mendip Horseshoe Bats SAC, that protected species will not be harmed or that biodiversity will not be harmed. In order to provide this information, a Habitats Regulations Assessment (HRA) would be required. The HRA process cannot be carried out through the PiP application process. The development is therefore contrary to the requirements of the Conservation of Habitats and Species Regulations 2017 and the Natural Environment and Rural Communities Act 2006, and to policy CS4 APPLICATION NUMBER - 25/P/2680/PIP
