Why it was refused
- The proposed two-storey side extension, by virtue of its minimal set-back and hipped roof form, would result in an incongruous addition that is out of character with the host property. The design fails to respect the architectural integrity of the dwelling and would have a detrimental impact on the visual amenity of the area. To permit the proposals would be contrary to Policy LP24 of the Kirklees Local Plan, KDP1 & KDP2 of the House Extensions & Alterations SPD and Chapter 12 of the National Planning Policy Framework.
- The side extension would significantly increase the extent of walling close to the shared boundary with 261 New Hey Road. Given the neighbouring property's alignment and lower land level, the proposal would result in an unacceptable overbearing impact on habitable room windows, particularly those serving bedrooms on the front elevation. To permit the proposals would be contrary to Policy LP24 of the Kirklees Local Plan, KDP6 of the House Extensions & Alterations SPD and Chapter 12 of the National Planning Policy Framework. The proposals failure to comply with Policy in terms of appearance, disproportionate additions, lack of subservience, cumulative impact and overbearing impact on the adjoining property. Amended plans have not been sought due to the plans not addressing the previously refused application and the principle matters of the concerns. Development within a Coal Mining Area DEVELOPMENT LOW RISK AREA - STANDING ADVICE The proposed development lies within a coal mining area which may contain unrecorded coal mining related hazards. If any coal mining feature is encountered during development, this should be reported immediately to the Mining Remediation Authority on 0345 762 6846 or if a hazard is encountered on site call the emergency line 0800 288 4242.
