Why it was refused
- The proposed use of the existing outbuilding as a beauty salon, together with associated client access through the curtilage, would not be incidental to the enjoyment of the dwellinghouse as such within the meaning of section 26(2)(d) of the Town and Country Planning (Scotland) Act 1997 (as amended), nor ancillary to the Class 9 use of the dwellinghouse (Town and Country Planning (Use Classes) (Scotland) Order 1997 (as amended)). As a matter of fact and degree, the proposal would result in a material change of use of the planning unit to a mixed use comprising a dwellinghouse and a commercial beauty salon. Such a change would constitute development requiring the Planning Authority's express grant of planning permission and would not therefore be lawful if instituted at the date of the application.
