Planning Decision

Why it was refused

  1. The proposed variation to Condition 4 would facilitate a form of development materially different from that approved under planning permission ref. 26/01410/FUL by allowing part of the extension approved at No. 27 Ridge Avenue to remain unconstructed. The original permission was assessed and approved as a coordinated scheme of joint development across both properties. No corresponding amendment to the approved plans condition has been sought and no revised plans have been submitted identifying the final form of development proposed. As such, the Local Planning Authority is not satisfied that the development now envisaged reflects the scheme originally approved, and the application fails to demonstrate that the proposed variation would secure an acceptable and coordinated form of development in terms of visual amenity and residential amenity. These deficiencies create fundamental uncertainty regarding the nature and extent of the proposed development, preventing the LPA from properly assessing the acceptability of the scheme. The proposal is contrary to the NPPF (2026), the London Plan (2021) policy D3, the Core Strategy (2010) policy CP30 and the Development Management Document (2014) policies DMD 8 and DMD 11.
