Planning Decision

Why it was refused

  1. The proposed 13-bedroom HMO, by reason of its intensive occupation and internal layout, would fail to provide a high-quality, comfortable and functional living environment for future residents. The cramped communal areas, inadequate details of kitchen and food-storage facilities, poor relationship between bedrooms and shared circulation and amenity areas, and potential for internal noise, loss of privacy and restricted outlook to bedrooms 1 and 2 would result in an unacceptable standard of accommodation. Insufficient information has also been provided to demonstrate that the access arrangements would be safe, secure, accessible and suitable for 13 residents. The proposal is therefore contrary to London Plan Policy D6, Core Policy 4 and Policies DMD 5, DMD 8 and DMD 9 of the Enfield Development Management Document.
  2. The proposed occupation of the property as a 13-bedroom HMO, together with the associated comings and goings and use of the first-floor external amenity space, would result in an unacceptable level of noise and disturbance to neighbouring occupiers, particularly during the early morning and late evening. In the absence of adequate noise assessment and sound-insulation details, it has not been demonstrated that noise transmission to adjoining properties would be satisfactorily controlled. The proposal would therefore harm neighbouring residential amenity, contrary to London Plan Policy D14, Core Policy 32 and Policies DMD 5, DMD 8 and DMD 68.
  3. The proposed part three-storey rear extension, balconies and associated alterations, by reason of their excessive scale, height, bulk, massing and modern design, would appear overly dominant and fail to remain subordinate to the host building. The development would not respect the traditional architectural character of Nos. 315-317 Green Lanes and would harm the character, appearance and group value of the locally listed terrace at Nos. 315-397 Green Lanes. The proposal would therefore conflict with London Plan Policies D3, D4 and HC1, Core Policies 30 and 31, and Policies DMD 11, DMD 37, DMD 38 and DMD 44.
  4. In the absence of a site-specific Flood Risk Assessment, Flood Management and Evacuation Plan and detailed Sustainable Drainage Strategy, it has not been demonstrated that the development would be safe from surface-water flooding throughout its lifetime, provide suitable flood-resistance and resilience measures, or avoid increasing flood risk elsewhere. The proposal also fails to demonstrate appropriate source-control SuDS and long-term drainage maintenance arrangements. The development is therefore contrary to London Plan Policies SI 12 and SI 13, Enfield Core Policy 28, Policies DMD 59, DMD 60 and DMD 61, and the flood-risk and sustainable drainage requirements of the National Planning Policy Framework 2026.
  5. In the absence of evidence to demonstrate that there is sufficient capacity to accommodate the parking demand, the proposed development would increase car parking pressure within the vicinity of the site, contrary to Policies DMD 5 and DMD 45 of the Development Management Document (2014) and Policies T6 and T6.1 of the London Plan (2021).
