Why it was refused
- The HMO by reason of its limited communal kitchen space layout as well as limited natural lighting to Rooms 2 and 3, would represent a substandard and inappropriate form of accommodation which would not be capable of meeting the reasonable needs of its occupiers and would be detrimental to the standard of living of the occupants. In addition, the layout of the property including its detached rear garage that is served by a rear alley could be put to better use by a single family dwelling in line with the existing arrangement, rather than an HMO and this would detract from the character of the setting. The scheme therefore fails to provide an adequate standard of residential accommodation and it is contrary to Policy D6 of the London Plan (2021), Core Strategy Policies CP4 and CP30, Development Management Document Policies DMD5, DMD7 and DMD37 as well as the NPPF (2026).
- The proposed rear dormer by virtue of its design, scale, siting and dimensions would give rise to a contrived, cluttered and bulky form of roof extension that would be detrimental to the character and appearance of the building and visual amenities of Kendal Avenue. Additionally, the dormer would create additional bulk to the roofscape to represent a dominant and incongruous addition and awkward relationship with the parent roofslope, thereby both unbalancing and detracting from the character and symmetry of the prevailing build form within the street scene. The proposals are thereby contrary to Policy D3 of the London Plan (2021), CP30 of the Core Strategy, DMD13 and DMD37 of the Development Management Document and the advice contained within the NPPF (2026).
