Planning Decision
Why it was refused
- The development does not fall within the permitted development criteria for Class AA (New dwellinghouses on detached buildings in commercial or mixed use) as construction is already underway for the addition of new storeys without first obtaining approval from the Local Planning that the development accords with the conditions set out within AA.2 (1) of Class AA of Part 20 of Schedule 2 of the GPDO 2015 (as amended). Furthermore, as construction works are already underway for the addition of new storeys, and a report for the management of the construction of the development has not been provided prior to the commencement of the development, the development would also fail to accord with Condition AA.2 (4) of Class AA of Part 20 of Schedule 2 of the GPDO 2015 (as amended). On this basis, prior approval is required and hereby refused.
- The floor to ceiling heights of the additional storeys measured internally, as illustrated on the Proposed Section Drawing (0563_00_NPD1105) would exceed the existing floor to ceiling heights of the principal part of the existing building at second and first floor levels and partly at ground floor level. The development would thereby be contrary to criterion AA.1 (e) of Class AA of Part 20 of Schedule 2 of the GPDO 2015 (as amended). On this basis, prior approval is required and hereby refused.
