Why it was refused

  1. Character and Appearance and Heritage Impact The proposed steel-framed structure would, by reason of its scale, permanent form, materials, enclosed appearance with roller shutter frontage and prominent position to the front of the building, would appear as an incongruous and visually intrusive addition that fails to respect the character and appearance of the host building, surrounding street scene and the Town Centre and Seafront Conservation Area. The development would detract from the visual amenities of the area and would fail to preserve or enhance the character or appearance of the Conservation Area, resulting in harm to the significance of this designated heritage asset. The proposal is therefore contrary to Policies B2, D10a and D10 of the Eastbourne Core Strategy 2013, saved Policies UHT1, UHT4 and UHT15 of the Eastbourne Borough Plan 2003, Section 72(1) of the Planning (Listed Buildings and Conservation Areas) Act 1990, and Policies DP3, HE4-HE7 of the NPPF 2026.
  2. Highway Safety and Public Highway The applicant has failed to provide sufficient information to demonstrate that the proposed structure would not encroach onto adopted highway land or prejudice the safe and convenient use of the public highway. In the absence of accurate plans and sufficient information regarding the extent of the highway and the impact of the development on pedestrian movement and highway operations, the Local Planning Authority cannot be satisfied that the proposal would provide a safe and suitable environment for all users. The proposal is therefore contrary to Policy D8 of the Eastbourne Core Strategy 2013 and Policies TR7 and UHT1 of the Eastbourne Borough Plan 2003 and TR4 of the NPPF 2026.
