Why it was refused

  1. 12 Coxwell Street is a grade II listed house, dating to the early C19th, aligned with its gable end onto the street, with its principal façade addressing its garden. The garden remains largely in its historic form and it forms an important part of the setting of the house, whilst also contributing to the density and grain, and appreciation of the historic and architectural character and appearance of Coxwell Street, which in turn forms an important part of the settlement pattern and evidencing historic development of the Cirencester Conservation Area, within which it lies. Under the Planning (Listed Buildings and Conservation Areas) Act 1990, there is a statutory duty for the Local Planning Authority to pay special attention to the desirability of both preserving the listed building or it's setting or any features is statutorily required to have special regard to the desirability of preserving the building or its setting or any features of special architectural or historic interest which it possesses, and preserving or enhancing the character or appearance of the conservation area. DCREFULZ 100120419308 26/00731/FUL The structure (including the flue) by virtue of its siting, scale, form, design, and materials would be uncharacteristically prominent in the setting of the listed building, situated to the front of its principal elevation, eroding the historic, architectural and proportional relationship between the house and its front garden, as well as diminishing the characteristic density, grain, and appreciation of the historic and architectural character and appearance of Coxwell Street, which in turn forms and important part of the settlement pattern and evidencing historic development of the Cirencester Conservation Area. Thereby, the proposals neither preserve the special architectural or historic interest of the listed building, nor preserve nor enhance the character and appearance of the Cirencester Conservation Area, nor sustaining the significance of either, as designated heritage assets. The harm would be less than substantial albeit considerable. Therefore, as there are not public benefits to outweigh the harm caused, whilst giving great weight to the conservation of the designated heritage assets the proposals would not be considered to accord with the duties of the Section 16(1) and 72(1) of the 1990 Act or Section 16 of the National Planning Policy Framework. The proposal is also contrary to Policies EN1, EN2, EN4, EN10 and EN11 of the Cotswold Local Plan 2011-31.
