10/To discharge the clause in paragraph 6 of Planning Obligation (1) dated 1st June 2004 in respect of application and decision number PA25/1675/03/B and c;lauses 1, 2 and 3 in the Third Schedule of Planning Obligation (2) dated 5th March 2012 in respect of planning application and decision number PA10/08596. The discharge seeks to remove the requirement in oblication (1) Not to sell let (other than for holiday lettings) charge or otherwise dispose of the land and all buildings thereon except as a whole and obligation (2) which state: 1. The dwelling shown coloured green on the Plan and comprising the Development shall only be owned and occupied in connection with the remainder of the Development Land and there shall at no time be any sale or other disposal of any estate or interest of any part or parts of the Development separate from the remainder of the Development Land. 2. For the avoidance of doubt there will be no sale letting or other disposal of part only of the Development Land as opposed to the whole of the Development Land. 3. The restrictions on disposal in paragraphs 1 and 2 of this Third Schedule shall not prevent the lawful occupation of the Development in accordance with such conditions as may be imposed on the decision notice to be issued in respect of the Application.
