Why it was refused

  1. The removal of the obscure glazing to the first floor side window would result in harmful impacts to neighbouring amenity. The proposed openings facilitate angles of overlooking, which result in an unacceptable erosion of the level of privacy afforded to occupiers of the nearest neighbouring property, in particular with regards to their existing external amenity space. For these reasons and in light of the harm identified, the development is contrary to Paragraph 135 of the National Planning Policy Framework 2024, which requires planning decisions to create places with a high standard of amenity for existing and future users. The application also conflicts with Colchester Borough Local Plan 2017-2033 Section 1 Policy SP7 and Section 2 Local Plan Policies DM13 and DM15, which, inter alia, require all development to protect the amenity of neighbouring residential properties, including in terms of avoiding unacceptable adverse impacts on privacy.

From the council's decision notice.
