Why it was refused

  1. The proposed development, by reason of its height, scale, massing, architectural treatment, poorly proportioned fenestration, inactive frontage to Eton Avenue and incongruous materials, would fail to respond positively to the established character of the surrounding area. The proposal would therefore appear as an unduly prominent and incongruous form of development that would neither complement the locality nor achieve the high standard of architectural and urban design required. The proposal is contrary to Policies DMP1, BD1, and BH4 of the Brent Local Plan 2019–2041, and the Brent Design Guide SPD1.
  2. The proposed development, by reason of its increased height, scale and close relationship with the south-facing elevation of No. 66 Sudbury Avenue, would result in an overbearing form of development, an increased sense of enclosure and a material loss of outlook for the occupiers of that property. In the absence of a daylight and sunlight assessment addressing the affected neighbouring windows, the applicant has failed to demonstrate that the development would not result in an unacceptable loss of daylight and sunlight. The proposal is therefore contrary to Policy DMP1 of the Brent Local Plan 2019–2041 and guidance set out in the Brent Design Guide SPD1.
  3. The proposed development would achieve an Urban Greening Factor score of only 0.24, substantially below the required score of 0.4. In addition, the submitted Biodiversity Net Gain information contains inconsistencies concerning the proposed areas of sealed surface, building footprint and green roof, such that the Local Planning Authority cannot be satisfied that the statutory biodiversity gain objective would be achieved. The proposal is therefore contrary to Policies BH4 and BGI1 of the Brent Local Plan 2019–2041, and Policy G5 of the London Plan 2021.
