Why it was refused

  1. The proposed change of use of the property would result in the loss of a four bedroom family dwellinghouse, and no justification has been provided to demonstrate that the need for a House in Multiple Occupation (HMO) in this location outweighs the important contribution this house made to the Council's objectives, strategies and policies relating to housing provision. As such, the application conflicts with Policy TP35 of the Birmingham Development Plan 2017, Policy DM11 of the Development Management in Birmingham DPD 2021 and the National Planning Policy Framework.
  2. The occupation of the property as an HMO by up to 8 unrelated people with varying lifestyles would result in a demonstrable increase in the numbers of comings and goings from the site and a greater level of noise and disturbance in comparison to the existing use as a family dwelling house. The proposed HMO would not, therefore, be appropriate to this location as it would result in unacceptable adverse impacts on the amenity of neighbouring occupiers, contrary to Policies DM2 and DM11 of the Development Management in Birmingham DPD 2021 and the National Planning Policy Framework
  3. The proposed change of use to a five bedroom HMO would introduce a more intensive residential use into an area characterised predominantly by traditional family housing. The scale of occupation and the overall pattern of activity generated by an 8 person HMO would be out of keeping with the established residential character. The proposal would therefore result in an unacceptable adverse impact on the character of the area, contrary to Policy DM11 of the Development Management in Birmingham DPD and the National Planning Policy Framework.
