Planning Decision

Why it was refused

  1. The proposed upward extension, by reason of its excessive height, scale, bulk and massing, would result in a visually dominant and discordant form of development that would fail to respond appropriately to the site's role as a transitional area between the higher-density mixed-use development fronting Hendon Way and the lower-scale suburban residential character of Allington Road. The proposal would erode the established hierarchy of building heights and cause unacceptable harm to the character and appearance of the area. The development would therefore be contrary to Policy CDH01 of the Barnet Local Plan (2021-2036), Policy D3 of the London Plan 2021, and the design objectives of the National Planning Policy Framework.
  2. The proposed development, by reason of the reintroduction of built form at upper levels and the addition of a fourth storey, would appear overbearing when viewed from neighbouring properties on Allington Road and would result in an increased sense of enclosure and an unacceptable loss of outlook to adjoining rear gardens. The proposal would therefore cause material harm to the residential amenities of neighbouring occupiers, contrary to Policy CDH01 of the Barnet Local Plan (2021- 2036), Policy D3 of the London Plan 2021 and the National Planning Policy Framework.
  3. In the absence of a completed planning obligation securing appropriate measures, including affordable housing review mechanisms and carbon offset contributions commensurate with the resultant scale of development, the proposal would fail to mitigate the impacts arising from the additional residential units. The proposal is therefore contrary to Policies HOU01, ECC01, and GSS01 of the Barnet Local Plan (2021-2036), the Council's Planning Obligations SPD and Policies SI2 and H5 of the London Plan 2021.
