Planning Decision

Decision
Refused
Case Officer
Oliver Rawnsley

Why it was refused

  1. Where visibility encroaches third-party land, there are concerns with the enforceability of any planning condition which seeks to secure visibility in perpetuity. The vehicular visibility splays shown on Drawing No. '26/08/0010 existing and proposed plans' are not acceptable, as the splay in the westerly direction crosses third party land. The visibility is therefore blocked to such an extent that it would be deemed unsafe to have a new access at that location. As a result, this application has been refused on highway safety grounds. SUMMARY OF POLICIES WHICH ARE RELEVANT TO THE DECISION: SP09 - Enhancement and Management of the Environment SP10 - Climate Change LP15 - Environmental Protection and Conservation LP16 - Biodiversity & Geodiversity LP23 - Sustainable Construction and Design LP24 - Design and Residential Amenity LP26 - Water resources and infrastructure LP27 - Flood risk and vulnerability LP29 - Safe, Sustainable and Active Transport NPPF - National Planning Policy Framework SP03 - The sustainable location of new development
