Planning Decision
Why it was refused
- NPPF (2026) Policy DP3 states that "Development proposals should respond to their context....so that they integrate with and enhance their surroundings" whilst Policy LP24 of the Babergh and Mid Suffolk Joint Local Plan (JLP) 2023 states: "All new development must be of high-quality design, with a clear vision as to the positive contribution the development will make to its context." Policy CMS4 of the Capel St Mary Neighbourhood Plan similarly seeks good design in developments. The proposal for two dwellings next to 6 Little Gulls would see a pairing of semi-detached dwellings, detached from the host and protruding several metres in front of the main building line of this row of houses, producing an incongruous form of development and eating into the corner space, diminishing the linear form and sense of openness which characterises this area. Whilst some limited form of development on this site is not opposed, the proposal has failed to take the chance to limit this by not removing an existing extension which would have facilitated the attachment of the proposed houses to the host dwelling, as well as providing adequate rear amenity space for all the dwellings involved. This was first mooted by the applicant and was advised during preapplication by the Local Planning Authority, but has not been pursued by the applicant, to the scheme's detriment. As such, the proposal would create an entirely avoidable and incongruous form of development, alien to its surroundings and contrary to the aims and objectives of the above policies. The application is, therefore, refused. SUMMARY OF POLICIES WHICH ARE RELEVANT TO THE DECISION: SP01 - Housing Needs SP03 - The sustainable location of new development SP09 - Enhancement and Management of the Environment SP10 - Climate Change LP15 - Environmental Protection and Conservation LP16 - Biodiversity & Geodiversity LP23 - Sustainable Construction and Design LP24 - Design and Residential Amenity LP29 - Safe, Sustainable and Active Transport
