Planning Application Details - DC/097710

We were granted planning permission to extend our boundary in April 2022 (DC/083877). This included incorporating a further strip of land approximately 1.5m in width running the length of the side boundary onto Clarence Road. We then applied and were granted a stopping up order to incorporate the land. During this time a new property was being built on some land behind us (previously the garden of 20 Lynton Road). The boundary of the new property followed the same continuous line along Clarence Road as our planning permission had granted us. Initially the plan was to build one continuous wall (as encouraged by the councilors) but for various reasons this did not happen as one project, and a wall was erected along Clarence Road for the new house, stopping at our border. In mid 2023 we applied to have some discharges lifted on our planning permission so we could start our project. We received confirmation of this in January 2024 (DC/088168). This enabled us to start the project when ready. In February of 2024 we were approached by people working at 22 Lynton Road (the new property) as they needed to modify the wall they had built to bring it in line with conservation (coping stones, pillar caps etc). They also need to remodel the gates giving vehicle access to their garden. This would require a pillar to be built on our land using the same materials as both their existing wall and our proposed wall. Having secured discharges on both materials and planting for our plans we agreed the pillar could be built. In March 2024 the 2m high brick pillar, requiring foundations, was erected. This pillar was/is the first pillar in our proposed wall, built out of the same materials that had been approved for our wall, and constructed by the person now looking to build the remainder of our wall. The pillar sits entirely on our land and it is our belief that it constitutes a material start to our works and so our planning permission should still be valid. We have been advised to appl
