1. The bungalow forms part of Chaseborough House Rest Home which is the subject of Planning Permission Ref. No. 3/88/1522 dated 29/11/88. Planning Condition No.2 of this planning permission requires that "the premises shall be used only for Rest Home and for no other purposes whatsoever, (including any other purpose in Class C2 of the schedule to the Town and Country Planning (Use Classes) Order 1987 or any subsequent re-enactment). The Council considers that the bungalow which was formerly a granny annexe to Chaseborough House when it was a dwelling, before its change of use to Rest Home, is part of "the premises" referred to in the above planning condition. 2. The occupants of the Bungalow Mr J and Mrs S Marshall, the Applicants, own and operate Chaseborough House Rest Home. Mrs S Marshall manages the Rest Home and it is registered in her name with Dorset County Council Social Services Department and has been since it was formed. The Council considers that the Applicants occupation of the Bungalow is consistent with their ownership and involvement with the operation of the Rest Home which would not be a breach of planning condition 2 of Planning Permission 3/88/1522. For the above reasons the Council does not consider that the Bungalow has been occupied as a separate and independent dwelling for a period of ten years back from the date of the application.
